A 56-year-old businessman has been charged for assaulting a Kenyan lady by pushing her while holding her breast.

Ajay Magon who appeared before a Nairobi Magistrate court for plea taking is alleged that on June 29, 2021, at Property World International offices along Raphta road in Kilimani sub-county within Nairobi County assaulted Carolyne Achieng Ongaya.

According to a police cover report seen by K24 Digital, Carolyne is a Personal Assistant to the Director of the company Ashish Magon who is the brother to the accused.

The report says that, on June 28, 2021, she reported to work as usual and after some time she was called by Ajay Magon and told to accompany him to town to buy some households.

After buying the goods, the accused told her to accompany him to another office in Upperhill. On arrival, according to the police report, the accused went inside the office and the complainant waited for him outside for hours.

Since it was getting dark, the complainant called her boss who is in UK to complain to him that his brother was keeping her late. Her boss then authorized her to go home.

As stated in the police document, on June 29, 2021, she reported to work at 8 am only to be barred from entering into the gate by the suspect who had become violent and shouting at everyone working in the compound.

She told the accused to allow her to pick some medicine she had left in his vehicle the previous day but the suspect could not hear her request. Instead, he pushed her by holding her breasts and shouting unprintable words.

"The suspect pushed her by holding her breasts and forced her out," the police cover report reads in part.

As the accused was assaulting the complainant, other bystanders came for her rescue. She then reported the matter at Kilimani Police station and was advised to seek treatment.

According to the statement from the complainant, the accused has been sexually harassing her but according to the accused’s statement, the complainant went to her place of residence and started demanding that she enters his house. He further says he neither touched nor assault her.

Ajay pleaded not guilty before Magistrate David Ndugi and was released on a bond of ksh200,000 or cash bail of Ksh100,000.
