Anne Kananu is the official Nairobi Deputy Governor – court rules

The High Court has, on June 24, ruled that nomination, vetting and swearing-in of Anne Kanunu as Deputy Governor was lawful.

The judges have however said that the attempts by Mike Sonko to withdraw the nomination of Anne Kananu as the Deputy Governor on December 7 last year were unlawful and without basis.

They further noted that the governor is only a nominating authority, not an approving authority. They add that Sonko could not unilaterally withdraw the nomination without the approval or consent of the County Assembly.

The Court had noted that upon nominating Kananu and after the county assembly received the nomination, Sonko's role in the process ended and were it not for the court order in the Agoro case the process would long have been concluded.

Justice Okwany said that "We are perplexed and find it hard to believe that a State Officer in the high office of a governor can have the temerity to state under oath that he took telephone instructions from ordinary citizens in the execution of his constitutional mandate."
